1. Acceptance of these Terms
These Terms of Service (“Terms”) govern your access to and use of the
National Trucking Services, LLC (“NTS,” “we,” “us,” “our”) website,
mobile application, and the filing services we provide (collectively the
“Services”). By creating an account, placing an order, or otherwise using
the Services, you agree to be bound by these Terms. If you do not agree,
do not use the Services.
You confirm that you are at least 18 years of age and authorized to
enter into a binding contract on behalf of yourself or the trucking
business you represent.
2. What we do — and what we don’t
NTS is a filing and compliance support service for new-venture and
existing motor carriers. We prepare and submit forms to government
agencies on your behalf, including but not limited to:

State LLC formation and registered-agent designation
•
IRS EIN / FEIN application (Form SS-4)
•
USDOT Number Registration with FMCSA
•
Motor Carrier (MC) Authority application (Form OP-1)
•
BOC-3 Process Agent designation
•
Unified Carrier Registration (UCR)
•
FMCSA biennial MCS-150 update
•
Other compliance filings as listed in our service catalog
NTS is not a law firm, accounting firm, insurance broker, or
fiduciary. We do not provide legal, tax, financial, or insurance
advice. Information we share — including content generated by the
in-app AI assistant — is for general informational purposes only.
For specific legal, tax, accounting, or insurance guidance, you should
consult a licensed professional.
3. Your account and accuracy of information
You must provide accurate, current, and complete information when
creating an account, placing an order, and submitting business details
(including DOB, SSN, addresses, vehicle information, and officer
information). You are responsible for keeping this information up to
date. You agree that NTS may rely on the information you submit to
prepare and file documents on your behalf, and you alone are
responsible for the accuracy of any data you provide.
You are responsible for maintaining the confidentiality of your account
credentials. You agree to notify us immediately of any unauthorized use
of your account.
4. Pricing, payment, and refunds
Service prices are listed in the in-app catalog and are quoted in U.S.
dollars. Government filing fees, state-imposed fees, and third-party
agent costs may be separate from and in addition to our service fee
and may be passed through to you at cost. We will disclose any
pass-through fee on the order before checkout.
Payments are processed by Stripe, Inc. Submitting a payment
authorizes us (and Stripe) to charge the payment method you provide.
Because government and third-party fees become non-refundable the moment
we submit a filing on your behalf, our refund policy is:

Before we begin work (i.e., before any document has been prepared
or submitted): you may request a full refund of the NTS service fee.
•
After we begin work but before submission to the agency: you may
request a refund of the NTS service fee minus a documented work-to-date
deduction.
•
After submission: government filing fees and third-party
pass-through fees are non-refundable. The NTS service fee is
non-refundable once the filing has been submitted on your behalf.

Disputes: please contact admin@nationaltruckingservice.com before
initiating a chargeback so we can resolve the issue directly.
NTS provides professional filing and compliance services, which are
generally not subject to state or local sales tax in the
jurisdictions where we operate, including California. As a result, NTS
does not collect sales or use tax on its service fees, and prices
shown in the catalog and at checkout are all-in for the NTS service
component.
If a state, county, or municipality determines that any portion of the
Services is taxable, you are solely responsible for any sales,
use, or excise tax owed. You agree to remit any such tax directly to
the applicable taxing authority and to indemnify NTS for any tax
assessment that arises from your transactions, except to the extent the
tax is a direct legal obligation of NTS.
Government filing fees, state-imposed registration fees (e.g., UCR,
CA DMV / MCP-65, CHP CA Number), and third-party pass-through costs
are regulatory fees, not taxes, and are itemized when applicable.
We make every reasonable effort to file documents quickly and
accurately, but timelines depend on third-party agencies (FMCSA,
IRS, state Secretaries of State, etc.) and are outside our control.
Estimates published in the catalog are typical, not guaranteed.
In particular, the MC Authority vetting period is set by FMCSA at
21 calendar days following publication in the FMCSA Register and may be
extended if the agency receives a protest.
6. Customer Service Agreement (e-signature)
By signing the Client Service Agreement (CSA) electronically inside the
app, you authorize NTS to act as your designated filer and to submit
applications and supporting documents on your behalf. Your e-signature
is legally binding under the federal E-SIGN Act (15 U.S.C. § 7001)
and applicable state laws. The signed CSA, the IP address used, and the
timestamp are stored as part of your order record.
7. Communications consent
By creating an account or submitting your contact information, you
consent to receive transactional emails from NTS regarding your account,
filings, and orders. These messages are necessary to deliver the
Services and cannot be opted out of without closing your account.
If you opt in to SMS notifications (separate, optional), the SMS Terms
& Opt-In also apply. Standard message and data rates may apply.
You may reply STOP at any time to unsubscribe. See /sms-terms.
•
Use the Services for any unlawful purpose or to violate any law,
regulation, or third-party right.
•
Submit false, fraudulent, or misleading information.
•
Attempt to circumvent, disable, or interfere with our security or
rate-limiting features.
•
Reverse-engineer, scrape, or copy substantial portions of the Services
for resale or competitive purposes.
•
Use the Services to file on behalf of a third party without their
written consent.
We may suspend or terminate accounts that violate these rules.
All content, software, branding, and copy provided through the
Services — except for documents and information you submit — is the
property of NTS or its licensors and is protected by U.S. and
international intellectual-property laws. We grant you a limited,
non-exclusive, non-transferable license to use the Services for the
purpose of obtaining filings and managing your orders. No other rights
are granted.
10. Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT
WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, AND NON-INFRINGEMENT. NTS DOES NOT WARRANT THAT FILINGS WILL
BE APPROVED, UPHELD, OR FREE FROM AGENCY DELAYS.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL NTS, ITS
OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF
OR RELATING TO YOUR USE OF THE SERVICES. NTS’ TOTAL CUMULATIVE
LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES
WILL NOT EXCEED THE AMOUNT YOU PAID NTS IN THE 12 MONTHS BEFORE THE
EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless NTS and its
representatives from any claim, demand, loss, or expense (including
reasonable attorneys’ fees) arising from (a) your breach of these
Terms; (b) your misuse of the Services; © your violation of any
law or third-party right; or (d) inaccurate or unlawful information you
submitted.
13. Dispute resolution; governing law
These Terms are governed by the laws of the State of Texas, without
regard to its conflict-of-laws principles. Any dispute arising out of
or relating to these Terms or the Services will be resolved
exclusively by binding arbitration administered by the American
Arbitration Association (AAA) under its Commercial Arbitration Rules,
seated in Harris County, Texas, in English.
You and NTS agree to resolve disputes only on an individual basis
and not as part of any class, consolidated, or representative
action. The arbitrator’s decision is final and binding. Either party
may seek emergency injunctive relief in a court of competent
jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be
announced in-app or by email at least 7 days before they take effect.
Your continued use of the Services after the effective date constitutes
acceptance of the revised Terms.
